Terms of Service

1. About us

This website, the Unnatural Selection online store and the Darwin Perception service are operated by Simon Paul Evans, a sole trader trading as Unnatural Selection, trading as Unnatural Selection (“we”, “us” or “our”).

Business address: 2 Millstream cottages, Westbury, Wiltshire, BA133SR

Contact email: hello@darkbeaconstudios.co.uk

These Terms explain the rules governing your use of our website, store and connected services, and the basis on which we sell products to you.

2. Acceptance of these Terms

By accessing our website, using Darwin Perception, connecting a third-party account or placing an order, you agree to these Terms.

If you do not agree, you must not use the relevant service. Nothing in these Terms limits any statutory rights that cannot lawfully be excluded.

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order or connect a third-party account.

3. Our products and services

Unnatural Selection sells print-on-demand garments and related products. Products may be printed and fulfilled by carefully selected third-party fulfilment providers.

Darwin Perception is a human-supervised research and analytics system. It may analyse product, storefront and organic-content performance information to help us assess designs and commercial strategies. Automated analysis is informational and does not independently make purchases, publish content, place advertisements or spend money.

We may add, remove or update products and features. This will not affect an order that we have already accepted unless we agree otherwise with you.

4. Product information

We take reasonable care to ensure that product descriptions, images, colours, sizes and prices are accurate.

Colours and appearance can vary slightly because of screen settings, garment materials and the print-on-demand process. Minor variations that do not materially alter the product are not defects.

You are responsible for checking the product description and size information before ordering.

5. Orders and contract formation

Placing an order is an offer to purchase the selected products.

We will normally send an order acknowledgement after receiving your order. This acknowledgement does not necessarily mean that we have accepted it.

A binding contract is formed when we send confirmation that the order has been accepted or dispatched, whichever happens first.

We may decline or cancel an order before acceptance where, for example:

  • A product is unavailable;

  • Payment cannot be authorised;

  • The price or description contained an obvious error;

  • Delivery is unavailable to the supplied address;

  • We reasonably suspect fraud, misuse or unlawful activity; or

  • Accepting the order would breach a legal or regulatory obligation.

If we cancel an order after taking payment, we will refund the affected amount.

6. Prices and payment

Prices are displayed in the currency shown at checkout. Applicable taxes, delivery costs and other mandatory charges will be displayed before you confirm payment.

You must provide accurate billing and payment information and must be authorised to use the chosen payment method.

Payments may be processed by Shopify or another identified payment provider. We do not receive or retain complete payment-card details.

7. Print-on-demand and personalised products

Many products are manufactured only after an order is accepted. A product being made on demand does not, by itself, remove rights provided by consumer law.

Where you request a genuinely personalised or custom-made product—for example, one containing text, artwork or specifications supplied or individually selected by you—your statutory right to cancel for a change of mind may not apply. We will clearly identify this before purchase where relevant.

This does not affect your rights if an item is faulty, damaged, misdescribed or otherwise fails to conform to the contract.

8. Delivery

Available delivery methods, estimated times and charges will be shown during checkout.

Delivery dates are estimates unless we expressly agree to a guaranteed date. We are responsible for the goods until they are delivered to you or a person nominated by you, subject to applicable law.

Unless another timeframe is agreed, we will deliver without undue delay and normally within 30 days after accepting the order.

Please contact us promptly if a parcel is delayed, lost or arrives damaged.

9. Cancellation, returns and refunds

For most non-personalised goods purchased online, UK consumers may cancel within 14 days beginning the day after delivery, without giving a reason.

After notifying us of cancellation, you normally have a further 14 days to return the goods. Unless the product is faulty or we state otherwise, you may be responsible for the direct cost of returning it.

We may reduce a refund where handling has gone beyond what would reasonably be permitted when examining an item in a shop and has diminished its value.

Where cancellation rights apply, we will make the required refund within the applicable legal period. We may wait until we receive the returned goods or evidence that they have been sent back.

Further instructions are provided in our Return and Refund Policy. That policy forms part of these Terms but cannot reduce your statutory rights.

10. Faulty or misdescribed products

Products must be of satisfactory quality, fit for their stated purpose and match their description, subject to applicable consumer law.

Contact hello@darkbeaconstudios.co.uk if you believe a product is faulty, damaged or misdescribed. Please include your order number and enough information for us to investigate.

Nothing in these Terms excludes remedies available under the Consumer Rights Act 2015 or other applicable law.

11. TikTok and connected accounts

Darwin Perception may allow a user to connect an authorised TikTok account using TikTok Login Kit.

When you choose to connect an account, TikTok will show the information and permissions being requested and ask for your consent. Our initial integration requests only:

  • Basic account information made available through user.info.basic; and

  • Read-only access to the account’s public video information through video.list.

The current integration is designed to read limited public-video metadata and engagement counts for analytics. It does not publish or delete TikTok content, send messages, manage advertising, make purchases or spend money.

You must connect only an account that you own or are authorised to manage.

You can withdraw TikTok access through your TikTok account settings or by contacting us. Following disconnection, we will stop making new requests using that authorisation. Handling of information already obtained is described in our Privacy Policy and remains subject to applicable legal retention requirements.

We do not sell information obtained from TikTok. We will not represent that our service is endorsed by or forms part of TikTok.

TikTok is an independent third-party service. Your use of TikTok remains governed by TikTok’s own terms and policies. TikTok may change, restrict or withdraw its services or programming interfaces, which can affect our integration.

12. Intellectual property

The website, software, branding, designs, graphics and other materials supplied by us are owned by us or used under licence and are protected by intellectual-property law.

You may use the website and purchased products for lawful personal purposes. You must not copy, reproduce, sell, distribute or exploit our website, software or designs without permission, except where the law permits it.

Third-party names, marks and content remain the property of their respective owners.

13. Content supplied by users

If a feature allows you to submit text, artwork or other material, you confirm that:

  • You own it or have the necessary permission to use it;

  • It does not infringe intellectual-property, privacy or other rights;

  • It is not unlawful, deceptive, defamatory, hateful, threatening or obscene; and

  • Our permitted use of it will not breach another agreement.

You retain ownership of your content. You grant us a limited licence to store, process, reproduce and use it only as reasonably necessary to provide the requested service, manufacture the product, fulfil the order and meet legal obligations.

We may reject or remove material that reasonably appears unlawful, infringing or inconsistent with these Terms.

14. Acceptable use

You must not:

  • Use our services unlawfully or fraudulently;

  • Attempt to bypass authentication, permissions or safety controls;

  • Interfere with the website, connected services or other users;

  • Introduce malicious code or conduct unauthorised security testing;

  • Scrape or collect information without permission;

  • Misrepresent your identity or authority;

  • Connect an account belonging to another person without permission; or

  • Use our services to infringe another person’s rights.

15. Third-party services

Our services may depend on Shopify, payment providers, fulfilment providers, TikTok and other third parties.

Their own terms and privacy policies may also apply. We are not responsible for third-party services outside our reasonable control, but this does not remove any responsibility that we have to you under consumer law.

Links to third-party websites are provided for convenience and do not necessarily imply endorsement.

16. Availability and security

We aim to provide a reliable and secure service, but we do not promise uninterrupted or error-free availability.

We may temporarily restrict access for maintenance, security, legal compliance or technical reasons. We will take reasonable care to protect the service and information under our control.

17. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

For consumers, we are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

We do not exclude or restrict your statutory consumer rights.

18. Privacy

Our collection and use of personal information are explained in our Privacy Policy:

https://nk3ehh-uq.myshopify.com/policies/privacy-policy

Please read that policy before using Darwin Perception or connecting a third-party account.

19. Suspension and termination

We may suspend or terminate access to a service where reasonably necessary because of a material breach of these Terms, unlawful activity, security risk or legal obligation.

Where appropriate, we will provide notice and a reasonable opportunity to resolve the issue.

Termination does not affect rights or obligations that arose beforehand, including accepted orders and applicable refund rights.

20. Changes to these Terms

We may update these Terms to reflect changes to our services, providers or legal obligations.

The effective date at the top identifies the current version. Changes will apply prospectively and will not remove rights relating to an order already accepted.

21. Governing law

These Terms are governed by the laws applicable in the part of the United Kingdom where our business is established, without depriving consumers of mandatory protections available where they live.

Consumers may bring proceedings in any court entitled to hear their claim under applicable law.
